Hi Ridhima,

Thanks for the blog its very helpful. I'm engaged and my fiancee is applying for passport is it okay if she carries her maiden name in the passport and then in the marriage certificate or if she just makes her passport with her first name only. Secondly, while filling the D158 form on her behalf should I say that she's married because at point we are not married and well get married in Nov. and immediately she'll go for the interview. If you can email me the answers it will be highly appreciated.

EJ,

Yes you can get your H4 stamped. All you need is your wife's (the principal H1 visa holder) I797 and other relevant documents.

Let me know if you have another question. Please share the outcome of your interview and I hope you get the stamping done without a problem.

Good luck !

Hi Ridhima,

I had a question for you. I was on h1 visa for 5 years. I recently became h4 visa and my wife is on h1 visa valid till July 2012.

I am planning to go to india in Aug 2010 to visit my parents.

my wife never travelled to india in the recent years.

Her H1 is not stamped on her passport. But the I 797 approval notice of H1 is present.

I also asked 5 lawyers and they said us consulate in india is the best place to ask this question and they felt it is ok to go for stamping of my H4 even though my wife h1 is not stamped in the her passport.

Can you kindly let me know from yours and your freinds experiences if the consular officers in india consulate are asking for h1 stamp requirement and are rejecting h4s if they do not have their hubby or wife H1 stamp in their respective passports?

HI Ridhima,

Thanks for u'r response , I got visa ...
they haven't asked about my status,But
i had to face lot of questions about my husband's job status like...
1) why my husband has changed his employer .
2) when did he change .
3) how much he is earning.
4) His bank statements & Tax Returns statements.
5) why i am staying for such long period in India Like this.
So my suggestion is if u'r husband has changed his employer u may encounter questions regarding his previous employer.

plz carry Rs 3000 - 5000/- money with u ( generally we won't carry our handbags into consulate) ,
due to some new changes for H4 visa we have to pay 912 rupees as extra fee , i have seen lot of people coming out for this reason.

These are my experiences ....
Thanks

Dear Malathi,

As discussed on this comments board, the probable line of questioning would be pretty much the same as your first interview.

However, the visa officer will certainly be interested to know YOUR INTENT of working in the U.S. after you get here, especially since you have converted your H4 to H1 previously.

Be sure to answer that you do not intend to work in the US and would simply like to accompany your spouse on the dependent visa (H4) and take care of your baby daughter.

Let us know how it goes!

Thank you,
Ridhima
